"Single-Window" Mechanism for Investment Projects in Hanoi’s High-Tech Parks and Industrial Zones

I. PRINCIPLES FOR PROCESSING PROCEDURES

The Management Board of High-Tech Parks and Industrial Zones of Hanoi (the "Management Board") serves as the primary point of contact for receiving applications, directly processing or coordinating the processing of procedures, and delivering results to investors throughout the entire lifecycle of their projects.

II. MODALITIES FOR INVESTMENT PROCEDURES

Investors may choose one of the following two processes:

1. Standard Investment Procedure

- Implementation Method: Investors carry out administrative procedures—sequentially or in parallel—as required by laws governing investment, technology, construction, land, the environment, and fire prevention and firefighting (FPFF). The Management Board directly handles procedures within its jurisdiction and acts as the coordinating body to obtain input from relevant state management authorities.

- Processing Time: The Management Board shall review and issue a Decision on Approval of Investment Policy within 17 working days from the date of receipt of a complete and valid application.

2. Special Investment Procedure

- Scope of Application: Investment projects located within a High-Tech Park that fall under the criteria specified in Article 28 of the 2025 Law on Investment.

- Procedure Streamlining Mechanism: Investors are exempted from the following requirements: obtaining approval for investment policy, preparing an Environmental Impact Assessment (EIA) report, undergoing appraisal of fire prevention and firefighting (FPFF) designs, and obtaining a construction permit. In lieu of these, investors must submit a "Commitment to Compliance" document as part of their investment registration application. - Investor Responsibilities: The management approach has shifted from "ex-ante" (pre-approval) control to "ex-post" (post-approval) oversight. Investors are responsible for ensuring compliance with the technical standards and regulations they have committed to; they are also subject to periodic or ad-hoc inspections and supervision by competent state authorities.

- Processing Time: The Management Board shall review and issue the Investment Registration Certificate within 15 working days from the date of receipt of a valid application.

III. PROJECT IMPLEMENTATION SEQUENCE

Step 1: Project Survey and Preliminary Assessment

Review the investment sector, proposed technology and products, eligibility for high-tech operational criteria, functional zoning plans, project location, land use requirements, and the capacity of existing technical infrastructure to meet project needs.

Step 2: Investment Procedures and Project Implementation Security

- The investor shall prepare and submit a project proposal (demonstrating financial capacity, experience, technology, products, project scale, implementation schedule, land use requirements, socio-economic benefits, etc.). The Management Board shall evaluate and appraise the proposal, then issue either a Decision on Approval of Investment Policy or an Investment Registration Certificate.

- The investor must fulfill the requirements for project implementation security within 30 days from the date of issuance of the Decision on Approval of Investment Policy or the Investment Registration Certificate. Step 3: Execution of procedures regarding planning, land, environment, construction, and fire prevention and firefighting (PCCC)

Depending on the option selected under Section II, the investor shall follow one of the two procedural tracks below:

- For projects following the standard procedure:

Planning, environmental, and PCCC procedures: Carry out procedures related to planning, environmental requirements, connection to technical infrastructure, appraisal of the feasibility study report, and approval of the fire prevention and firefighting (PCCC) design.

Land and infrastructure procedures: Complete procedures for land lease requests and the handover of the site; sign agreements for the use of technical infrastructure and connections for electricity, water, and telecommunications.

Construction permitting procedures: Conduct an appraisal of the construction design (developed subsequent to the basic design), obtain PCCC design approval, and secure a construction permit prior to the commencement of construction.

- For projects following the special procedure:

The investor is exempted from all the aforementioned procedures concerning planning, construction, environmental impact assessment (EIA), and PCCC. Please note: if the project is subject to a mandatory environmental permit, the investor must complete the procedures to obtain such a permit before commencing construction.

Prior to the commencement of construction, the investor shall submit a written notification of construction commencement to the Management Board, accompanied by: (1) The construction investment economic-technical report, prepared, appraised, and approved by the investor; and (2) A report on the verification of the construction investment economic-technical report—covering structural safety, environmental protection, PCCC, and compliance with technical standards and regulations—issued by a qualified organization or individual. Step 4: Construction, final acceptance, and project operation

Carry out construction in strict accordance with the design documentation, permits, and the commitments made in the project dossier.

Conduct final inspections and acceptance procedures—including those for fire safety and environmental protection—to certify the completion of the project and authorize its entry into service. Commence project operations while ensuring full compliance with the commitments outlined in the project dossier.

Submit periodic or ad-hoc investment monitoring reports as required.

IV. POST-LICENSING MANAGEMENT AND DIGITIZATION OF PROCEDURES

- Regarding the 100% online execution of administrative procedures: All procedures related to investment, construction, labor, etc., are processed and resolved entirely within an electronic environment. Applications must be submitted online, and the resulting outcomes are issued as electronic documents via the administrative procedure processing system.

- Regarding inspection, guidance, and operational support: The Management Board is responsible for providing instructions on the procedures for adjusting projects whenever changes occur; it shall also lead and coordinate efforts to resolve difficulties and obstacles related to labor and customs matters. Furthermore, the Management Board shall monitor and conduct periodic or ad-hoc inspections to ensure that investors comply with legal regulations concerning investment, technology, land, construction, and environmental protection.
